Menendez RECALL OKAYED
A state appeals court ruled 3/16/10 New Jersey’s secretary of state must accept a petition a citizens group filed to recall U.S. Sen. Robert Menendez, but left open the question of whether the removal effort itself is constitutional.[ Read the full story at NJ.com ]

NEXT STEPS
While the Court has "stayed" its order that the recall can begin, pending appeal, the organizers are proceeding to set up their system for action, once the case clears the courts.
1) FILE NOTICE OF INTENT TO RECALL with NJ Secretary of State. (Done, 9/25/09) Department of State must review proposed petitions within 3 days and either certify them as meeting the requirements, or offer instructions on how to fix technical errors so petitions will be acceptable. (Department of State acknowledged receipt of Notice on 10/5/09, but FAILED to certify the petitions or offer corrections. On 11/25/09, a civil complaint was filed by the petitioners with the Essex County Superior Court against the Secretary of State and Director of the Division of Elections for failure to comply with the Law.
2) BEGIN CIRCULATING APPROVED PETITIONS. This step will begin once the format of the petitions has been approved. Petitioners will then have 320 days in which to gather legal signatures equal to 25% of the voters REGISTERED to vote in the Nov. 2009 General Election. No reason is required to recall Sen. Menendez.
3) IF A SUFFICIENT NUMBER OF SIGNATURES IS GATHERED (of legally registered voters in NJ), then a SPECIAL ELECTION would be scheduled and voters would be asked whether or not to Recall Senator Menendez.
4) If a majority of voters voted YES, to recall, then the Secretary of State would immediately declare Senator Menendez recalled, and he would be notified that he has been discharged from office and the Office would be declared vacant.
5) APPOINTMENT OF INTERIM SENATOR. The Governor would then appoint someone to serve as U.S. Senator from New Jersey until an Election could be scheduled to fill the unexpired term (to 2012).
